THIS AGREEMENT IS SUBJECT TO BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS. THIS MAY LIMIT YOUR ABILITY TO BRING CLAIMS IN COURT OR HAVE DISPUTES DECIDED BY A JUDGE OR JURY. THESE TERMS ALSO INCLUDE PROVISIONS THAT LIMIT OUR LIABILITY TO YOU.

Like most companies, we have some detailed Terms of Service, and Safety and Equipment Guidelines and it’s divided into clear sections that explain different aspects of Atomix’s services. Essentially, these terms outline how we aim to provide you with a reliable service, guided by fair rules and mutual expectations.

Atomix Safety & Equipment Guidelines
At Atomix Fitness (Art Fitness LTD) your safety is our top priority. To ensure every session is both effective and injury-free, we ask all clients to follow these equipment rules and safety procedures.
Equipment Rules
Treadmills
- Always bring the treadmill to a complete stop before stepping off. Leaving the treadmill moving can be very dangerous for the next person who uses it.
- Never place weights, mats, or personal belongings on or behind the treadmills.
- Using the pause button, lowering the speed, or switching off is the proper way to stop the treadmill safely after a sprint, which helps prevent wear on the machine and reduces the risk of injury.
- Always attach the safety tag to your clothing before using the treadmill – it will stop the machine instantly in an emergency. Make sure the cord is straight and untangled.
Floor Stations
- Use only the mats and weights provided by Atomix Fitness (Art Fitness LTD).
- Keep the area behind the treadmills clear at all times (never place weights between the bench and the treadmills).
- When placing weights back in the bench, ensure that no one is coming up from floor work, and avoid letting the weights come into contact with another person’s head.
Safety Procedures
Instructor Communication
- Inform your instructor before class if you have any injuries, health conditions, or movement limitations.
- Ask questions freely and feel comfortable modifying exercises when needed.
Form & Technique
- Focus on proper form before increasing weight or intensity.
- Always follow the guidance of your instructor to maintain safe technique.
Attire
- Wear fully enclosed athletic shoes.
- Choose comfortable, appropriate workout clothing.
General Studio Conduct
- Show respect to fellow members, instructors, and staff.
- Be mindful of others and never act in a way that compromises safety.
1. DEFINITIONS
- “Atomix” / “we” / “us” / “our” means Atomix Fitness (Art Fitness LTD), including its owners, employees, trainers, and representatives.
- “Clients” / “you” / “your” means any individual accessing, purchasing, or using Atomix services.
- “Services” means all fitness classes, training sessions, studio facilities, memberships, events, and related offerings provided by Atomix.
2. ELIGIBILITY
- You must be at least 16 years old to participate in Atomix classes.
- Individuals under 18 must have written parental or guardian consent.
- You confirm that you are in good health and physically capable of participating in strenuous exercise.
3. HEALTH & SAFETY
- You acknowledge that participation in fitness activities involves inherent risks, including but not limited to injuries, heart attacks, muscle strains, and accidents.
- Atomix strongly recommends consulting a physician before starting any new fitness program.
- By participating, you voluntarily assume all risks and agree that Atomix is not liable for injuries, health issues, or damages that may result.
- You agree to follow all safety instructions and studio rules.
4. CLASS BOOKINGS
- Class packages, and pricing are available on our website or in-studio.
- All packages are personal, non-transferable, and non-refundable, except as required by Swiss consumer protection law.
- Student discounts are intended solely for a single named student and are non-transferable. Sharing sessions with family or others is strictly prohibited and may result in forfeiture of credits.
- Class bookings are subject to availability and must be made via our booking system.
- Atomix reserves the right to cancel or reschedule classes due to operational needs, instructor availability, or force majeure.
5. PAYMENTS & BILLING
- Payments can be made via credit card, debit card, or other accepted methods.
- By purchasing a package, you authorise Atomix to charge your payment method in accordance with the chosen plan.
6. CANCELLATIONS & REFUNDS
- Class cancellations must be made at least 12 hours in advance for morning classes and 5 hours in advance for lunch and evening classes to avoid forfeiting a credit.
- Refunds will only be granted where required under Swiss law.
7. STUDIO RULES & MEMBER CONDUCT
- Respect other members, trainers, and staff at all times.
- Proper athletic attire and footwear are required.
- No alcohol, drugs, or unsafe conduct is permitted on the premises.
- Atomix reserves the right to suspend or terminate packages for inappropriate behavior, rule violations, or misuse of facilities.
8. PERSONAL BELONGINGS
- Lockers are provided for temporary use during classes.
- Atomix is not responsible for loss, theft, or damage to your personal belongings.
9. LIMITATION OF LIABILITY
- To the fullest extent permitted by Swiss law, Atomix shall not be liable for:
– Injuries or health issues resulting from your participation in our services
– Indirect, incidental, or consequential damages
– Loss or damage to personal property - Our total liability for any claim is limited to the amount you paid for the service giving rise to the claim.
10. PRIVACY & DATA PROTECTION
- Atomix respects your privacy. Personal data collected during registration or bookings will be handled in accordance with Swiss data protection law.
- By using our services, you consent to the processing of your personal data for the purpose of providing and improving our services.
11. GOVERNING LAW & DISPUTE RESOLUTION
- These Terms are governed by the laws of Switzerland.
- In the event of any dispute, the parties agree to first attempt to resolve the matter amicably.
- If unresolved, disputes shall be submitted to binding arbitration in Zurich, Switzerland, in accordance with the Swiss Rules of International Arbitration.
- By agreeing to arbitration, you waive the right to bring disputes before a court, except where such waiver is not permitted under Swiss law.
12. CLASS ACTION WAIVER
- You agree that any claims against Atomix will be brought on an individual basis, and not as part of a class, consolidated, or representative action.
13. MODIFICATIONS TO TERMS
- Atomix may update these Terms from time to time.
- The latest version will always be available on our website, with the effective date clearly stated.
- Continued use of our services after changes means you accept the updated Terms.

MEMBERSHIP TERMS & CONDITIONS
Effective from: 1st of October 2026
These Membership Terms & Conditions (“Terms”) apply specifically to the 8 session and 12 session memberships offered by ART FITNESS AG, operating as Atomix Studio in Zürich (“Atomix”, “we”, “us” or “our”).
By purchasing an Atomix membership, you confirm that you have read and accepted these Terms.
1. MEMBERSHIP OPTIONS
Atomix offers two recurring monthly memberships:
- ATOMIX 8
CHF 239 per month
Includes 8 class sessions per monthly membership period. - ATOMIX 12
CHF 336 per month
Includes 12 class sessions per monthly membership period.
Both memberships are available to new and existing Atomix clients. Memberships are personal to the individual member and may only be used by the person registered to the membership.
2. MEMBERSHIP TERM
Each membership operates on a monthly billing cycle. The membership is subject to a minimum initial term of three consecutive monthly membership periods.
During this initial three-month term, the membership cannot be cancelled, except where mandatory applicable law provides otherwise. After the initial three-month term, the membership automatically continues on a month-to-month basis until cancelled in accordance with these Terms.
3. MEMBERSHIP SESSIONS
Each monthly membership period provides the member with:
- 8 sessions or
- 12 sessions
Sessions may be used to reserve eligible Atomix classes, subject to availability. One membership session is used for each class booking. Membership sessions are personal and cannot be transferred, sold, shared or given to another person.
4. EXPIRY OF UNUSED SESSIONS
Membership sessions are allocated for the relevant monthly membership period. Unused sessions do not carry forward into the following month. Any unused sessions remaining at the end of a monthly membership period automatically expire. Unused sessions cannot be exchanged for cash, refunded, transferred to another person or credited towards a future membership period. Members are responsible for using their available sessions within the relevant monthly period.
5. CLASS BOOKINGS
Members may use their available sessions to reserve eligible Atomix classes through the Atomix booking system. All bookings are subject to class availability. A booking uses one session from the member’s available monthly allocation. Members may not reserve more classes than the number of sessions available to them unless they purchase additional sessions separately.
6. CANCELLATION OF CLASS BOOKINGS
A member may cancel a class booking without losing the session provided the cancellation is made at least 5 or 12 hours before the scheduled class start time. Where a booking is cancelled less than 5 or 12 hours before the scheduled start time, the session will be considered used and will not be returned to the member’s available balance. If a member does not attend a class they have booked and does not cancel the booking, the session will also be considered used. There is no separate late-cancellation or no-show fee. In exceptional circumstances, Atomix may, at its discretion, restore a session that would otherwise be forfeited.
7. ADDITIONAL SESSIONS
If a member has used all sessions included in their monthly membership, additional sessions may be purchased separately at the applicable Atomix rate. Additional sessions are subject to the terms applicable to the relevant purchase and do not increase the number of sessions included in the member’s recurring monthly membership. Purchasing additional sessions does not alter the member’s existing membership term or renewal arrangements.
8. MEMBERSHIP FEES AND PAYMENT
The applicable membership fee is:
- 8 sessions: CHF 239 per month
- 12 sessions: CHF 336 per month
The membership fee is charged monthly using the payment method provided when the membership is purchased. By purchasing a membership, the member authorises Atomix or its authorised payment provider to process the recurring monthly membership payments for the duration of the membership.
If a payment cannot be successfully processed, Atomix may temporarily restrict access to membership bookings and benefits until the outstanding payment has been received.
Any applicable charges resulting from failed payments will only be imposed where permitted by applicable law and where appropriately communicated to the member.
9. MEMBERSHIP CANCELLATION
The membership has a minimum initial term of three consecutive monthly membership periods.
After completion of the initial three-month term, the membership may be cancelled with one month’s notice, effective at the end of a monthly membership period.
The membership therefore continues during the applicable notice period, and the normal monthly membership fee remains payable during that period. The member may continue to use the sessions included in their membership during the final membership period, subject to the normal booking and cancellation rules.
Any unused sessions remaining at the end of the final membership period expire and are not refundable or transferable. Cancellation must be submitted using the cancellation method specified by Atomix.
10. NO PAUSE OR FREEZE
Atomix 8 and Atomix 12 memberships cannot be paused or frozen.
If a member no longer wishes to continue their membership, they may cancel it in accordance with Section 9.
Atomix does not provide automatic extensions or additional membership periods because a member is unable or chooses not to attend classes during an active membership period, subject to any mandatory rights under applicable law.
11. CHANGING MEMBERSHIP
A member may request to change between Atomix 8 and Atomix 12.
Any change is subject to Atomix’s current membership availability and will normally take effect from the beginning of a new monthly membership period.
Atomix will communicate the applicable membership price before the change takes effect. Changing from one membership to another does not reset the member’s initial three-month commitment unless expressly agreed otherwise by Atomix.
12. PERSONAL AND NON-TRANSFERABLE MEMBERSHIP
Atomix memberships are strictly personal. An Atomix 8 or Atomix 12 membership may not be:
- transferred to another person;
- sold;
- shared;
- gifted; or
- used by anyone other than the registered member.
Atomix may request reasonable identification or verification where necessary to confirm that a membership is being used by the registered member.
13. ACTIVE MEMBERSHIP AND PAYMENT STATUS
Membership benefits are available only while the membership is active and payments are up to date.
Where an account has an outstanding membership payment, Atomix may temporarily restrict access to bookings and membership benefits until the payment issue has been resolved.
Resolving an outstanding payment does not restore sessions that have expired or been forfeited under these Terms.
14. MEMBERSHIP PRICE CHANGES
The membership price applicable at the time of purchase will be communicated clearly to the member. Atomix may change its membership prices for future membership periods. If a price change affects an existing recurring membership, Atomix will provide reasonable advance notice before the new price takes effect. A price change will not affect membership fees that have already been paid.
15. CHANGES TO THE MEMBERSHIP PROGRAMME
Atomix may make reasonable changes to the membership programme, including changes to class availability, booking procedures or the operation of the membership system. Where a change materially affects an existing membership, Atomix will provide appropriate notice. Nothing in these Terms is intended to exclude or restrict any mandatory rights available to members under applicable law.
16. MEMBERSHIP AVAILABILITY
Atomix may decide when Atomix 8 and Atomix 12 memberships are available for purchase and may introduce, discontinue or modify membership products for future purchases. Any change will not affect a membership period that has already been paid for, except where otherwise permitted or required by applicable law.
17. GOVERNING LAW
These Terms are governed by Swiss law, subject to any mandatory consumer protection provisions that may apply. Nothing in these Terms is intended to exclude or restrict rights that cannot legally be excluded or restricted.
18. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
The invalid or unenforceable provision will be interpreted or replaced, where legally possible, in a manner that most closely reflects its intended purpose.
